CAN I GET DIVORCED WITHOUT GOING TO COURT?
During this “time of COVID,” a lot of in-person tasks have gone virtual. And although we are starting to see things open back up a bit here in Illinois, not everyone is eager to get back to “business as usual” when it comes to in-person activities. With many studies showing a rise of divorce cases–thanks in part to quarantine stress–many couples are wondering if they have to physically go to court to get a divorce.
The short answer: Maybe not.
Because no two divorces are the same, the answer to this seemingly simple question isn’t that simple. Even if the terms of the divorce are agreed upon in advance, the agreement must still be presented to a judge. In DuPage County, that may mean simply sending in all of the required agreed to paperwork for the judge to review and potentially grant the divorce. In other counties, the parties may still need to appear for their Judgment to be ordered but it may be via a Zoom call versus in person.
Also, if you’re the one petitioning for the divorce, you may have to appear at the final hearing, depending on the county you live in, but your soon-to-be-ex-spouse does not have to attend—assuming he/she has signed all necessary documents.
The bottom line is this: if you are looking for a quick and uncomplicated divorce in which you spend the least amount of time in court, work with one another—and your lawyer– to agree on terms of the settlement before the final hearing. This will save you a lot of time, money, and—most importantly—emotional stress.
